Levin Sedran & Berman LLP partners Daniel Levin and Frederick Longer are lead counsel in Mallory v Norfolk Southern. Mr. Mallory sued Norfolk Southern in Philadelphia Common Pleas Court for injuries he sustained working for the defendant. Levin Sedran and Berman has vigorously prosecuted Mr. Mallory’s right to sue defendant in Pennsylvania before the Pennsylvania Supreme Court and the United States Supreme Court. The U.S. Supreme Court is considering whether plaintiffs have a right to sue corporations in any state where state law requires the corporations to submit to general jurisdiction in order to register to do business in the state. The defendant railroad argues that state laws requiring such consent to general jurisdiction are unconstitutional.
