Levin Sedran & Berman wins Mallory v. Norfolk Southern at the United States Supreme Court

Levin Sedran & Berman filed a lawsuit in Philadelphia Common Pleas Court on behalf of Robert Mallory for personal injuries he sustained as an employee for Norfolk Southern Railroad. Norfolk Southern defended the lawsuit on the grounds that Pennsylvania courts lacked personal jurisdiction over the railroad. After the Pennsylvania Supreme Court ruled in favor of Norfolk Southern, Levin Sedran and Berman appealed the case to the United States Supreme Court. On June 27, 2023, The United States Supreme Court agreed with Mr. Mallory and held that Pennsylvania’s statutes requiring corporations who register to do business in the Commonwealth consent to personal jurisdiction do not violate the Due Process Clause.
